The whole site and the orders made via this site are subject to the French laws and rules. The general conditions of sale are subject to the French law and are applicable to all the business relations, existing or to come, between the company SEMEC and every legal, public or private entity endowed with the necessary legal capacity for making orders on the site http://www.mytradeshow-cannes.com Only the general conditions of sale published on-line on the site http://www.mytradeshow-cannes.com are to be respected by the SEMEC. Any on-line order in conformance with a product or with a service supposes the preliminary consultation and the acceptance of the general conditions of sale. The SEMEC remains free, at any time, to enrich, to modify, to correct or to delete all or any of the present general conditions of sale. The applicable general conditions of sale are the ones current at the time of the order. 2. Essential characteristics of products and servicesProducts and services proposed on www.mytradeshow-cannes.com are intended for the customers, the companies and the professionals of the sector of shows, congresses and exhibitions. According to the proposed service offer, it can involve a sale of a product, a temporary rent on a limited duration, or a provision of an executing service at a date and hour fixed during the exhibition. The services proposed in the on-line sale are defined in the description of articles and on every logo. The photographies present a global sight of every article, certain chromatic changes can appear because of the IT support of the customer. The photographies of the site are considered as not-contractual. Every customer has the possibility of obtaining further information (article L 111-1 of the Consumption Code) by contacting the CUSTOMER SERVICE from Monday to Friday from 9:00 am to 12:00 am and from 2 pm to 6 pm. 3. Validity of the offersThe commercial propositions on the services are not permanent. The dates of validity of the offers proposed on the www.mytradeshow-cannes.com site are clearly mentioned on the homepage and are associated with the exhibition. All proposed articles are as a rule available. In case of not availability of the ordered article, the customer receives an email, and he is then free to choose a similar product proposed by the CUSTOMER SERVICE or to give up his order. In the hypothesis where the customer would have settled his order and has to give it up for unavailability of the article, the SEMEC commits to establish a credit note and to pay off the customer. The indicated prices for every on-line article are in Euros. These indicated prices are exclusive of tax and except insurances. Any modification, at the express demand of the customer, of the executing conditions, starting or guarantee will be followed by an update of the order. The net price of the order takes into account the VAT (Value-added tax), the possible insurances, and the modifications requested on on-line articles. The net price of the order is established in Euros (incl. VAT) and is mentioned to the customer before payment. 4. Validation of the ordersThe customer confirms his order having marked the compartment " I agree with the general conditions of sale ". By this action, the customer recognizes to have acquainted with the general conditions of sale and to accept them without reserve. The customer has to make an on-line payment of his order before its validation. The confirmation of the payment activates the definitive validation of the order. The customer receives an E-mail confirming the recording of his order and its payment. This confirmation activates the order of treatment and execution of the service provision. 5. ProofThe SEMEC keeps in the form of archives a copy of the confirmation E-mail of the order being worth proof of date, object and modalities of the order in the sense of the law of March 13th, 2000. 6. PaymentOn the www.mytradeshow-cannes.com site, only the payments by bank card are accepted. The accepted bank cards are Carte Bleue, Visa, Mastercard in France and abroad. The www.mytradeshow-cannes.com site uses a secured method of payment type SSL (Secure Socket Layer) on the on-line payment platform SOGENACTIF. The banking data are coded. The payment platform is in conformity with the international interbank standards and with the Grouping of Bank cards. Any order must be paid before being validated. The center of banking payment gives its preliminary trade agreement after control of authentification and solvency of the bank card. In case of refusal of the center of payment, the order cannot be confirmed and the customer will be informed by email. Any paid order gives place to the establishment of a downloadable invoice using PDF format. This invoice necessarily has to include the company name and the address of the customer. 7. DeliveryThe delivery of any services will be made on the indicated stands during the periods of assembly and before the opening of the exhibition. This delivery will be made at the stand of which the customer has indicated the number and on which the customer commits to receive the ordered articles. The delivery of products and the execution of the concerned services will be made during the periods indicated and agreed with the customer. In case of delivery of a damaged product, the customer will have to inform the SEMEC of his reserves by contacting directly the CUSTOMER SERVICE: Exhibition Control Room of the SEMEC 8. EnvironmentThe SEMEC undertook a policy of environmental protection and sustainable development. Containers allowing the selective sorting of the waste are at disposal of the exhibitors and the visitors on all the exposure areas of the Palais des Festivals et des Congrès of Cannes. Loose packagings, worn carpets, used covers, objects not serving at once or being of no use any more to the realization of the event must be stored or poured into garbage can spaces exclusively planned for that purpose. The waste is subject to the selective sorting decree N94-609 of July 13th, 1994. No food or empty waste must be thrown in the trucks of industrial waste, but in the containers planned for that purpose. We remind you that you do not have to get rid of your waste of electric and electronic equipments which must be sorted out and redeemed in a selective way. Indeed, this electric and electronic waste of equipment contains dangerous substances having potential effects for the human health and the environment. For your information, the SEMEC offers the services of sorting and removal of the waste and the recycling of used materials according to the French rule. 9. Right of retractionThe customer has a right of retraction and cancellation of his order if he cannot go to the exhibition because of force majeure. This right of retraction cannot be exercised for the period of 10 calendar days preceeding the date of assembly of the exhibition. This retraction and this demand of cancellation of the order must be established by e-mail, fax or in writing by registered mail with acknowledgement of receipt and must be sent by mail by registered mail with acknowledgement of receipt to the CUSTOMER SERVICE Exhibition Control Room of the SEMEC. The SEMEC reserves the right to grant the retraction, to establish a credit note and to accompany it with a refund by credit card or by check. 10. Property and responsibilityThe SEMEC keeps the property of articles ordered in the case of a temporary rental of the material for the duration of the event. Nevertheless, the customer is considered as person in charge of the rented products from their delivery on and has to be insured for damages and civil liability. The SEMEC cannot be considered as person in charge of the damages of all kinds, material immaterial or physical, which could result from a bad functioning or from a misuse of temporarily rented articles. 11. Respect for the name specific dataCertain information is compulsory because necessary for the identification of the customer, for the treatment and for the execution of the orders, and for the issuing of invoices. The order is not validated if piece of information of this compulsory information is missing. This name specific information can be the object of a licit use in commercial purposes by the SEMEC. According to the law " Computing and Liberties " the treatment of the name specific information relative to the customers of the SEMEC collected on our web sites are the object of a statement with the National Committee for Computing and Liberties (CNIL). The customer has an access right of modification, rectification and deletion of the data which concern him that he can practice by directly contacting the SEMEC at the following address regie.exposant@palaisdesfestivals.com 12. DisputesThe present contract is subject to the French law. In case of complaint or of discord, the parties will try to find an amicable solution before engaging any contentious appeal. In case the dispute would persist on the interpretation or the application of the present contract, the parties agree to recover from it in the exclusive appreciation of the Courts of Cannes. |
